Terms of Service

These Terms govern your use of https://tradesvpa.com and the TVPAAI receptionist service (the “Service”), operated by Michael James, a sole proprietor doing business as TVPA (TradesVPA), located at 156 Ivy Street, West Hempstead, NY 11552. By using the Service you agree to these Terms.

TVPA provides an AI-powered virtual receptionist for residential trade businesses. The Service may include inbound and outbound voice calls, SMS messaging, email, appointment booking, quote generation, and payment collection on your behalf.

We offer a free demo and trial period. During the demo we may call the phone number you provide and send transactional SMS and email as described in our SMS Terms and Privacy Policy. No payment is collected during the demo period.

Paid plans are billed monthly with a one-time setup fee. Pricing is disclosed before purchase. You may cancel at any time effective at the end of the current billing period. Setup fees are non-refundable once the Service has been provisioned for your account.

You agree not to:

• Use the Service to contact recipients who have not consented to be contacted.
• Use the Service to send unlawful, harassing, deceptive, or abusive content.
• Attempt to reverse-engineer, scrape, or interfere with the Service.
• Resell or sublicense the Service without our written permission.

We reserve the right to suspend or terminate accounts that violate these terms or that put our messaging or telephony deliverability at risk.

Your data — including call recordings, transcripts, customer records, and messages handled by the Service on your behalf — remains yours. We process it as described in our Privacy Policy.

We aim for high availability but do not guarantee uninterrupted service. The Service depends on third-party providers (telephony, LLMs, hosting) and may be affected by their outages. We are not liable for missed calls or messages caused by carrier or provider failures.

The Service is provided “as is” without warranties of any kind, express or implied, to the maximum extent permitted by law.

To the maximum extent permitted by law, TVPA's total liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months immediately preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Nassau County, New York.

We may update these Terms from time to time. Material changes will be notified by email to active customers. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
